Agreement to these Terms

These Terms of Service ("Terms") govern your access to and use of websites and mobile applications operated by Vibe Labs s.r.o. ("Vibe Labs," "we," "us"), including thevibelabs.com and our apps (e.g. Hazel, Flick) (collectively, the "Services").

By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Description of Services

Vibe Labs builds consumer mobile software and related web properties. Features, content, and availability may change over time. We may add or remove functionality, subject to applicable law and app store rules.

Accounts and eligibility

Some features may require an account. You agree to provide accurate information and keep credentials confidential. You are responsible for activity under your account. We may suspend or terminate accounts that violate these Terms or pose risk to the Services or other users.

Subscriptions and purchases (Apple App Store)

Paid features may be offered as auto-renewing subscriptions or other in-app purchases processed by Apple through the App Store. Payment, billing, renewal, and cancellation are governed by Apple's terms and your Apple ID settings. We do not store your full payment card details for App Store purchases.

If you have billing questions, check your Apple subscription settings. For product-specific help, contact us at the support email listed in the relevant app or on our website.

Advertising

Some tiers or features may be ad-supported. Ads may be delivered through Google AdMob, AppLovin, and other partner networks as mediated or configured in the app (which partners are active may vary by build, platform, or region). On iOS, Apple's App Tracking Transparency may apply when our partners request permission to track for personalized ads; you can manage this in Settings. Other ad choices and privacy controls may be available through your device and platform settings. Our Privacy Policy explains how data may be used in connection with ads, analytics (including product analytics via providers such as Mixpanel), and measurement.

Acceptable use

You agree not to:

• Violate applicable laws or third-party rights.
• Attempt to gain unauthorized access to the Services, other accounts, or our systems.
• Interfere with or disrupt the Services (including excessive automated access).
• Reverse engineer, decompile, or attempt to extract source code except where permitted by law.
• Use the Services to distribute malware, spam, or harmful content.
• Misrepresent your identity or affiliation.

Third-party services and links

The Services may integrate or link to third-party services (e.g. cloud providers, analytics, attribution, authentication). Their use may be subject to separate terms and privacy policies. We are not responsible for third-party services we do not control.

Intellectual property

The Services, including software, design, text, graphics, and branding, are owned by Vibe Labs or our licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose.

You may not copy, modify, distribute, sell, or lease any part of our Services without permission, except as allowed by law.

Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBE LABS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM (IF ANY), OR (B) FIFTY EUROS (€50), EXCEPT WHERE PROHIBITED BY LAW.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

Indemnity

You will defend, indemnify, and hold harmless Vibe Labs from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your content, or your violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.

Governing law and venue

These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-law principles. Courts in the Czech Republic shall have jurisdiction, subject to mandatory consumer protections that may apply in your country of residence.

Changes to these Terms

We may modify these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. If changes are material, we may provide additional notice (e.g. in-app or by email). Continued use after changes become effective constitutes acceptance of the revised Terms.
